    Feds Crushing States Rights???

    Now, I don't claim to know much about politics or how our legal system works here in the US, most I took was a 12th grade civics class, but I can't find anywhere that says the government can tell the states that they are not allowed to have medical marijuana.

    I was wondering how you guys thought about this issue. I know there are many more of you that know more about this sort of thing, so please, if you have an opinion, do share!

    Federal law states that Marijuana is a drug and is not legal to use, grow or have in your possession. Simple as that.

    Typically, however, the federal government is limited in how much it can regulate such things within the states. The states that passed medical marijuana thought that since there is no interstate commerce involved, that there would be no legal way for the feds to interfere. For some unfathomable reason, the US Supremes ruled otherwise.

    This is being tested here in Nevada as there are 3 or four that
    have been arrested here for growing it stating the Federal Gov't
    has made a Law that is Unconstitutional.( I dont know if true or not as I am not a lawyer ,but protest is a good way to have an issue examined I feel)

    personally ,I think there is too much big Gov't involvement
    and yes since 9/11 some nescessaraly so...
    but Big Brother doesnt need to get his fingers in domestic pies that local goverment can deal with.
    deal with the drugs coming over the border like mad and leave the few that have cancer in their state
    grow with permission do so and
    if they abuse that let local police deal with it I say.

    medicinal marijuana should definitely be legalized, in my opinion. There is, or used to be a safe shop in Vancouver where HIV and other terminally ill people could go and smoke a joint, either to help ease the pain of their condition, or to help stimulate hunger in those who had difficulty eating.
    Pharmacology isn't the only answer, and Federal law isn't always set by morality or the best interest of those it's claiming to protect. It can often be influenced by strong corporations, religious authorities, and even other countries.

    Basically, it looks to be a decision in support of the federal government's right to regulate interstate commerce, and that the court didn't really buy into the argument that it was purely intrastate, for various reasons spelled out in the decision.

    It has an impact on the fed's ability to regulate if something that is illegal to grow and sell federally is legally grown within the physical borders of the U.S.

    And no, I am not against m.j use, medical or otherwise. Just pointing to the stated goals of the decision. The correct avenue of activists to redress here is to have marijuana reclassified at the federal level. Good luck with that, as tobacco seems to be heading the exact opposite direction, with alchohol not far off its heals. Apparently there are a lot of people with very short fuses these days where recreational drug use of any sort is concerned.

    I don't know much about the whole 'medical' aspect of marijuana. I have heard there is a legal extract of it, and then that the legal extraxct doesn't work well on some patients, then that the legal extract has been proven in clinical trials. *shrugs* So.... bleh. I'd say just lobby to get it reclassified and point to the rediculous amount of money being spent on jails for marihuana possession. Lucky me, I don't even like the stuff, but I am about tired of it being such a huge deal and would gladly have it legalized just for the peace and quiet factor.
